What belongs to the customer?
Subject to the Terms & Conditions and any third-party rights that apply, the customer owns:
- their domain;
- their logo;
- their photographs;
- content they supplied;
- written content created specifically for their website by Toolbelt Websites;
- the customer-facing visual website design and other customer-facing creative material, subject to the proprietary technology distinction below.
If Toolbelt Websites arranged a standard available domain for you, that does not make the domain Toolbelt Websites' property.
What does Toolbelt Websites retain?
Toolbelt Websites retains ownership of its proprietary software, reusable technology and other pre-existing intellectual property. This distinction allows customers to keep what belongs to them without transferring ownership of the underlying technology used to provide the managed service.
Put simply: owning the content and customer-facing design does not mean the proprietary technology used to provide the managed service is transferred to the customer or another developer.
What happens to my domain if I leave?
You own the domain. If it is already held in your own registrar account, it can remain there.
If Toolbelt Websites originally purchased and manages the domain and you cancel the Toolbelt Websites service, Toolbelt Websites can transfer it to you or your chosen registrar. The cancellation-domain transfer administration fee is £50 + VAT.
That cancellation fee does not apply where you remain an active Toolbelt Websites customer and simply choose to move the domain to your own registrar. For general domain guidance, see What happens to my existing domain?.
Does owning the design mean I receive every part of the managed website system?
No. If you leave completely, Toolbelt Websites may provide a static public-facing version of the website where practical, together with customer-owned material. Proprietary Toolbelt Websites software and managed functionality are not supplied as a transferable platform.
Another developer is free to create or recreate a replacement website independently using the customer-owned content and assets.
